Terms of Use (English)

1. Purpose & Scope of Service

These Terms govern the relationship between the individual provider (the "Provider") and users regarding the use of Canny (the "Service").

The Service's main function is to generate and deliver videos based on the user's uploaded audio/video, applying voice dubbing and lip-sync modifications to match the dubbed voice.

2. Prohibited Uses

The User must not engage in the following. The prohibitions automatically extend to any present or future applicable laws, whether explicitly cited herein or not.

• Violations of the laws of the Republic of Korea or the User's country of residence
• Creation, distribution, possession, or viewing of deepfake sexual content or other materials prohibited under Article 14-2 of the Act on Special Cases Concerning the Punishment of Sexual Crimes
• Any illegal content involving children or juveniles
• Use of others' likeness, voice, or personal data without consent; infringement of copyrights, publicity or other rights
• Fraud, defamation, threats, stalking, hate or discriminatory content that harms others
• Security circumvention, hacking, reverse engineering, or abuse of the Service

3. Output & Disclosure Recommendation

• The User bears full responsibility for any output generated via the Service.
• The Provider recommends indicating that the output is AI-generated and embedding service name, creation time, and a user identifier in a digital watermark or metadata.

4. Accounts, Restrictions & Refunds

• If the User transfers/loans the account to others or provides false information, the Provider may restrict or terminate access without prior notice, and fees already paid are non-refundable.
• If the Service is unavailable for more than 24 consecutive hours, the Provider will extend the subscription by the duration of the outage (extension in lieu of cash refunds).

5. Billing & Auto-Renewal

• Fees for paid services are those indicated at the time of payment.
• For auto-renewal, the Provider may not provide advance notice. Users must check renewal dates and amounts themselves. If not canceled before the renewal date, payment for the next period will be processed automatically.

6. Data Retention & Law-Enforcement Cooperation

• The Provider may retain personal data, usage records, and generation logs within legal limits for service operation, prevention of unlawful use, and compliance with legal or investigative requests.
• Upon lawful request, the Provider may disclose relevant information to investigative, judicial, or administrative authorities.
• Even if deletion is requested, data may be retained where legally required or reasonably necessary for disputes or investigations.
• Video Retention Policy: Uploaded source videos and generated videos are stored only in Supabase Storage, and the Provider does not separately extract or retain them.
• Retention Period: Source and generated videos are retained for 7 days and then automatically deleted. Due to the storage provider's system characteristics, technical backup copies may exist for a period, but they will be deactivated and permanently deleted after expiration.

7. Disclaimer & Limitation of Liability / Indemnification

• All civil and criminal liability arising from the User's illegal or Terms-violating actions rests solely with the User.
• The Provider is not responsible for reasons not directly attributable to the Provider, such as User's illegal actions, third-party rights infringement, or third-party service (e.g., platform/cloud) failures.
• The User shall indemnify the Provider for damages arising from the User's violations.
• To the maximum extent permitted by law, the Provider's total liability shall not exceed the amount paid by the User for the Service in the past 3 months.

8. Amendment of Terms

The Provider may amend these Terms when relevant laws or service policies change. Changes apply from the time of notification through service announcements. Continued use of the Service after changes constitutes agreement to the amended Terms.

9. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Korea. Any dispute shall be brought exclusively in the Pohang Branch of the Daegu District Court as the court of first instance.
